Can your insurer pick your shop?

Short answer: no. In California, you decide where your car is repaired.

What the law says

California Insurance Code section 758.5 says an insurer can't require you to have your car repaired at a specific shop. An insurer can recommend a shop only if you ask for a recommendation, or after it has told you in writing that you have the right to choose.

"Preferred" or "direct repair" shops

Many insurers have a network of shops they work with. Using one is your choice, not a requirement. Your claim is the same claim wherever the car is repaired.

What to tell your adjuster

Keep it simple:

"I've chosen GV Auto Collision, 794 Merchant St, Unit 3, Los Angeles, CA 90021, phone (310) 654-6484. Please send the estimate and any inspection there."

What happens next

  1. We inspect the car and document the damage with photos.
  2. We work with the adjuster on the estimate.
  3. If hidden damage turns up during repair, we send the insurer a supplement for approval (see Guide 03).
  4. You get updates by text, and a written report when you pick up the car.

What you pay

On a covered claim under your own policy, you usually pay your deductible. If the other driver was at fault and their insurer accepts the claim, you usually pay nothing. Anything outside the claim is done only if you approve it in writing first.
